Indication and yet fundamental component of any constitutional state and modem setting, is the recognition of fundamental human rights and constitutional protection. In this sense, as human rights are meant the civil, social and individual rights, althought after the emergence of a globalized form of governance has emerged as a new category, the "new generation rights" as called, which is related to new forms of rights that require protection.
