BitCoin: ευκαιρία ή κίνδυνος: νομική προσέγγιση

Abstract

Στόχος της παρούσας διπλωματικής εργασίας είναι η παρουσίαση της έννοιας και της λειτουργίας του bitcoin. Το κρυπτονόμισμα bitcoin αποτελεί ένα κομμάτι της σύγχρονης πραγματικότητας και παρά τους εγγενείς κινδύνους του χρησιμοποιείται από μεγάλη μερίδα χρηστών. Από νομικής σκοπιάς παραμένει αρρύθμιστο. Παρ’ ότι στους νομικούς κύκλους γίνονται συζητήσεις για τη νομική του φύση και για το αν αποτελεί χρήμα εν στενή εννοία ή εν ευρεία έννοια ή αν τελικά είναι πράγμα δεν έχει εκδοθεί νομοθέτημα μέχρι σήμερα που να κωδικοποιεί τη χρήση και λειτουργία του. Ωστόσο, σε πλείονες έννομες τάξεις έχουν εκδοθεί προειδοποιήσεις αναφορικά με τη χρήση του και τους κινδύνους από αυτή, ιδίως ως προς τη διευκόλυνση τέλεσης αξιόποινων πράξεων μέσω αυτού και πρωτίστως ως μέσο τέλεσης ξεπλύματος βρώμικου χρήματος. Ως προς την λειτουργία του αξίζει να αναφερθεί ότι ανήκει στην κατηγορία των blockchain, γεγονός που αυξάνει την εμπιστοσύνη στους χρήστες, αφού όλες οι συναλλαγές που διενεργούνται σε bitcoin εγγράφονται στο μητρώο αυτό, αφού πρώτα επαληθευθούν από τους εξορύκτες, ενώ η κατοχή τους εξασφαλίζεται μέσω ενός ηλεκτρονικού πορτοφολιού στο οποίο συνδέονται εύκολα με τη χρησιμοποίηση της διεύθυνσής τους και του ιδιωτικού κωδικού που μόνο αυτοί γνωρίζουν.

This present paper aims to present the meaning of the term bitcoin and to describe the way it functions. The cryptocurrency bitcoin is a part of the modern transactions reality and despite its dangers, an increased number of users choose to use it for their transactions. From a legal perspective only a few comments can be made, as Law remains silent. There are many conversations held within the legal community related to the nature of the cryptocurrency bitcoin but there is not even one complete legal framework in force. Some claim that bitcoin shall be included in the meaning of money, whether other are adamant that bitcoin even if it presents some of the characteristics of money, shall not be included in the meaning of money, as it is provided by the law, but it is shall be considered as an item, used for the transactions as a pay tool. Many countries have issued notifications – warnings in order to notify the dangers of the usage of the bitcoin to the consumers, emphasizing on its usage as a means of committing crimes, such as money laundering. As far as its function is concerned it shall be mentioned that bitcoin is a blockchain application, which means that and each transaction held in bitcoin upon its confirmation by the miners, becomes a part of the blockchain.
