Το παιγνίδι της καταπάτησης: παρατήρηση για τον τρόπο ύπαρξης του νόμου στην Ελλάδα

Abstract

Σχεδὸν ἀπ᾽ ὅταν ἐπανιδρύθηκε ἡ Ἀθήνα, ἄτομα προσποιοῦνται ὅτι εἶναι ἰδιοκτῆτες, γιὰ νὰ γίνουν, προσποιοῦνται ὅτι τὸ σπίτι τους εἶναι νόμιμο, γιὰ νὰ γίνει. Ἔτσι ἔχουν κτισθεῖ ὁλόκληρες συνοικίες. Τὰ οἰκόπεδα πωλοῦνταν ὑπὸ τὸν ὅρο νὰ οἰκοδομηθοῦν γρήγορα, ὥστε ἡ δικαιοσύνη νὰ βρεθεῖ πρὸ τετελεσμένου καὶ ἐν τέλει ἡ περιοχὴ νὰ μπεῖ στὸ σχέδιο. Τὸ μεμονομένο αὐθαίρετο ἐπίσης νομιμοποιεῖται ἐκ τῶν ὑστέρων. Ἡ μελέτη τοῦ 1993 τῶν Ἴψεν, Χάιντενράιχ καὶ Χτούρη περιγράφει πῶς γίνονται αὐτά.[1] Ὑπάρχει ἐδῶ μιὰ ἔννοια «μπλόφας» μὲ ὀργανικὴ κοινωνικὴ σημασία. Προσποιοῦμαι ὅτι ἔχω κάτι, φέρομαι σὰν νὰ τὸ εἶχα, κι ἔτσι τὸ ἀποκτῶ, ὑποχρεώνω τὴν πολιτεία νὰ μοῦ τὸ δώσει. Ἂς ποῦμε ὅτι πρόκειται γιὰ ἕνα παιγνίδι, τὸ παιγνίδι τῆς καταπάτησης. Δὲν εἶναι περιθωριακὸ φαινόμενο, αὐτὸ τὸ πρωθύστερον χαρακτηρίζει πολλῷ μᾶλλον τὸν τρόπο ὕπαρξης τοῦ νόμου στὴν χώρα. Γι᾽ αὐτὸ ἀξίζει νὰ σταθοῦμε σὲ αὐτό.

Almost since Athens was re-established, people have pretended to be property owners in order to become them, they pretend their house is legal in order for it to become legal. This is how entire neighborhoods have been built. The plots were sold on the condition that they would be built on quickly, so that the justice system would be faced with a fait accompli and eventually the area would be included in the city plan. Individual unauthorized buildings are also legalized retroactively. The 1993 study by Ipsen, Heidenreich, and Chtouris describes how these things happen.[1] There is a concept of "bluffing" here with organic social significance. I pretend to have something, behave as if I had it, and thus I acquire it, forcing the state to give it to me. Let's say it's a game, the game of encroachment. This is not a marginal phenomenon; this posteriority rather characterizes the way law exists in the country. That's why it's worth focusing on this.
