| dc.description.abstract | Αντικείμενο της παρούσας μονογραφίας, όπως προκύπτει και από τον τίτλο της, είναι η νομική θεωρία της επανάστασης. Πρόκειται για τη θεωρία, που διαμορφώθηκε από το δημόσιο δίκαιο και η οποία ασχολείται με την έννοια της επανάστασης και τις συνέπειές της για το δίκαιο και το κράτος. Η εργασία εξετάζει ιδίως την έννοια της επανάστασης και την προβληματική της δικαιοπαραγωγικής εξουσίας αυτής. Ειδικότερα, εξετάζονται η αναγνώριση, η θεμελίωση, και οι προϋποθέσεις εφαρμογής της αρχής της δικαιοπαραγωγικής εξουσίας της επανάστασης στην αλλοδαπή, στην Ελλάδα και στο διεθνές δίκαιο. Η μελέτη ασχολείται επίσης με την ερμηνεία της πρωτότυπης διάταξης του άρθρ. 87 § 2 του ισχύοντος Συντάγματος της Ελλάδας, η οποία αποκλείει τη δικαιοπαραγωγική εξουσία του πραξικοπήματος. | el |
| dc.description.abstract | The subject of this monograph, as its title suggests, is the legal theory of revolution. It is a theory that was formed by public law and that deals with the concept of revolution and its consequences for law and the state. The work examines in particular the concept of revolution and the problematic of this legal power. In particular, the recognition, foundation, and conditions for the application of the principle of the legal power of revolution abroad, in Greece and in international law are examined. The study also deals with the interpretation of the original provision of art. 87 § 2 of the current Constitution of Greece, which excludes the legal power of the coup. | en |
