Τα όρια και οι συνέπειες του δεδικασμένου στις αποφάσεις του

Abstract

Η παρούσα εργασία τιτλοφορείται "Τα όρια και οι συνέπειες του δεδικασμένου στις αποφάσεις του ΔΕΕ" και χωρίζεται σε 2 μέρη. Στο πρώτο μέρος αναλύονται τα όρια του δεδικασμένου μέσω μιας θεωρητικής προσέγγισης της έννοιας και ερευνάται η θέση που η εν λόγω αρχή κατέχει στην ενωσιακή έννομη τάξη. Στο δεύτερο και πιο πρακτικό μέρος γίνεται μια επιμέρους τριμερής διάκριση αναλόγως με το ποιους δεσμεύουν οι αποφάσεις του ΔΕΕ. Ειδικότερα, αναλύονται οι συνέπειες που επέρχονται στα κράτη- μέλη, τα ενωσιακά όργανα και τους ιδιώτες ανάλογα με το είδος της εκδιδόμενης απόφασης και το εάν αυτή περιβάλλεται με ισχύ δεδικασμένου.

This thesis is entitled "the limits and the consequences of res judicata on decisions of ECJ " and is divided into 2 parts.In the first part, the analysis of the limits and the boundaries of the concept of res judicata takes place through a theoretical approach and the position that this principle holds in Union law is investigated. The second and more practical part is a separate tripartite distinction depending on who bind the ECJ decisions. In particular, there are described in detail the effects that occur in the EU Member States, EU institutions and individuals depending on the type of judgments and if it is surrounded by res judicata.
