Η αντιμετώπιση και διαχείριση του παγκόσμιου προβλήματος της κλιματικής αλλαγής συνιστά ένα από τα δυσκολότερα και πολυσύνθετα περιβαλλοντικά ζητήματα με τα οποία η διεθνής κοινότητα ασχολείται τις τελευταίες δεκαετίες. Με τη θέσπιση του διεθνούς καθεστώτος για την κλιματική αλλαγή, το οποίο οικοδομήθηκε τη δεκαετία του ΄90 με τη Σύμβαση-Πλαίσιο για την Κλιματική Αλλαγή (1992) και το Πρωτόκολλο του Κιότο (1997), τα κράτη επιχειρούν να αντιμετωπίσουν το πρόβλημα της παγκόσμιας υπερθέρμανσης του πλανήτη μέσα από την προαγωγή συλλογικών δράσεων και την εφαρμογή διεθνών κανόνων. Ο θεμελιώδης σκοπός του διεθνούς συμβατικού καθεστώτος για την προστασία του γήινου κλίματος συνίσταται στη συγκράτηση της μέσης θερμοκρασίας του πλανήτη σε ένα επίπεδο που να αποτρέπει την επικίνδυνη ανθρωπογενή παρεμβολή στο παγκόσμιο κλιματικό σύστημα. Ως εκ τούτου, μέσα από τη διαχρονική εξέλιξη και ανάπτυξη του καθεστώτος, ο πυλώνας του μετριασμού των εκπομπών έχει αναδειχθεί σε βασικό συστατικό στοιχείο της διακυβέρνησης της κλιματικής αλλαγής. Η διατριβή πραγματεύεται ένα από τα σημαντικότερα ζητήματα της περιβαλλοντικής διπλωματίας, τη μελέτη του ρόλου και της συμβολής των μείζονων ρυπαινόντων στην ανάπτυξη και εξέλιξη του πυλώνα του μετριασμού του διεθνούς συμβατικού καθεστώτος για την κλιματική αλλαγή. Στο πλαίσιο αυτό, πρωταρχικός σκοπός της διατριβής είναι η σκιαγράφηση, ανάλυση και αξιολόγηση: α) των βασικών συστατικών παραμέτρων του διεθνούς καθεστώτος για την κλιματική αλλαγή, β) της διαχρονικής εξέλιξης των διαπραγματευτικών θέσεων τριών βασικών Συμβαλλομένων Μερών του καθεστώτος - της Ευρωπαϊκής Ένωσης, των ΗΠΑ και της Κίνας – στο πλαίσιο της διαπραγμάτευσης του πυλώνα του μετριασμού των εκπομπών, καθώς και γ) του βαθμού και της έκτασης της επιρροής των εν λόγω Μερών στην τελική διαμόρφωση θεμελιωδών πτυχών των νομικών και διακηρυκτικών κειμένων του διεθνούς καθεστώτος για την κλιματική αλλαγή.
Abstract:
Addressing the global climate change problem constitutes one of the most complex and multi-dimensional environmental issue that the international community has to cope with over the past decades. With the international climate change regime, which was established during the early 90’s, based on the UNFCCC (1992) and the Kyoto Protocol (1997), the global community attempts to manage the global warming problem through the promotion of collective actions and the implementation of international rules. The ultimate objective of the international conventional regime of climate change is to hold the increase in global temperature below a level that prevents dangerous anthropogenic interference with the climate system. Therefore, through the evolution and development of the regime, the mitigation pillar has emerged as a core component of climate change governance.The dissertation addresses one of the most critical issues of environmental diplomacy: the role and contribution of major emitters in the development and evolution of the mitigation pillar of the international conventional regime of climate change. In particular, the main purpose of the dissertation is to outline, analyze and evaluate a) the basic parameters of the international climate change regime, b) the evolution of the negotiating positions of the three main Contracting Parties to the regime - European Union, USA and China – regarding the mitigation pillar, and c) the influential role of the above-mentioned Parties in the process of formulating key provisions of the legal and soft-law texts adopted in the context of the international climate change regime.
