Περίληψη:Η παρούσα διπλωματική εργασία εστιάζει σε ζητήματα προσβολής και προστασίας των δικαιωμάτων των συγγραφέων, των οποίων τα έργα συνιστούν εν δυνάμει "αντικείμενο ψηφιοποίησης" στο Διαδίκτυο, ιδίως δε στο πλαίσιο δημιουργίας μιας Ψηφιακής Βιβλιοθήκης (ΨΒ). Εισαγωγικά και ως αφορμή του προβληματισμού της μελέτης, αναπτύσσεται η περίπτωση του "Google Library Project" (ως τμήμα του ευρύτερου "Google Books Search Project"), με το οποίο η εταιρία Google επιχείρησε (και εν μέρει κατάφερε) να ψηφιοποιήσει εκατομμύρια βιβλία αμερικανικών πανεπιστημιακών βιβλιοθηκών και όχι μόνον, παραγνωρίζοντας, όμως, τα ζητήματα πνευματικής ιδιοκτησίας που ανέκυπταν, είτε επρόκειτο για προστατευόμενα από την πνευματική ιδιοκτησία έργα, είτε για "μη διαθέσιμα στο εμπόριο" ή για "ορφανά έργα". Αρχικά, οριοθετούνται οι βασικές έννοιες που συνθέτουν το εγχείρημα των Ψηφιακών Βιβλιοθηκών, εντοπίζονται οι διαφορές τους με τις παραδοσιακές έννοιες της Πνευματικής Ιδιοκτησίας, ενώ παρατίθεται και η σχετική διεθνής, ενωσιακή και εθνική νομοθεσία, με μικρές αντιπαραβολές προς το αμερικανικό δίκαιο του copyright. Εν συνεχεία, μελετάται η αναγνώριση και εφαρμογή των "ψηφιακών δικαιωμάτων" (ως επιμέρους εξουσίες του περιουσιακού δικαιώματος) που απονέμονται στον δημιουργό - συγγραφέα από το δίκαιο της ΠΙ, οι προβλεπόμενοι περιορισμοί του περιουσιακού δικαιώματος των δημιουργών που βρίσκουν εφαρμογή στο Διαδίκτυο, με ιδιαίτερη έμφαση στην εξαίρεση της ιδιωτικής αναπαραγωγής καθώς και στη γενική ρήτρα των 3 σταδίων. Υπογραμμίζεται εκ προοιμίου, ότι η μαζική ψηφιοποίηση ως πράξη αναπαραγωγής για τη δημιουργία μιας ΨΒ δεν εμπίπτει σε κάποια προβλεπόμενη εκ του νόμου εξαίρεση. Επιπλέον, γίνεται μνεία στις νέες τάσεις συμβατικής εκμετάλλευσης του πνευματικού έργου στο Διαδίκτυο και σε συμβατικά μορφώματα, όπως είναι η Γενική Δημόσια Άδεια και η περίπτωση των αδειών Creative Commons που βρίσκουν ιδιαίτερη πρακτική εφαρμογή στην περίπτωση των ΨΒ. Σε επόμενο κεφάλαιο γίνεται αναφορά στις επιμέρους εξουσίες του ηθικού δικαιώματος, οι οποίες βρίσκουν εφαρμογή στα ψηφιακά συγγραφικά έργα καθώς και στους τρόπους προσβολής αυτών των δικαιωμάτων κατά τη δημιουργία αλλά κατά τη χρήση μιας ΨΒ. Ακολουθεί μία καταγραφή των πράξεων, ενεργειών ή τεχνολογικών μεθόδων, οι οποίες μπορεί να συνιστούν προσβολή του δικαιώματος του δημιουργού ή/και των δικαιούχων συγγενικών δικαιωμάτων κατά τη χρήση της ψηφιακής τεχνολογίας ενώ, εν συνεχεία, αντιμετωπίζεται το πρόβλημα των "ορφανών έργων" σε συνάρτηση με τη μαζική ψηφιοποίηση. Μελετάται, επίσης, το κρίσιμο ζήτημα της επιβολής των δικαιωμάτων πνευματικής ιδιοκτησίας και σχολιάζονται τα "δικανικά όπλα" των θιγομένων μέσα από την αναγκαία παράθεση νομολογιακών παραδειγμάτων, για να ακολουθήσει μία προσέγγιση της προστασίας που παρέχει η Τεχνολογία στην Πνευματική Ιδιοκτησία (ΠΙ) μέσω των τεχνολογικών μέτρων προστασίας, των πληροφοριών για το καθεστώς διαχείρισης των δικαιωμάτων και των συστημάτων διαχείρισης ψηφιακών δικαιωμάτων (DRMs), ενώ εκτίθεται σχετικός προβληματισμός αναφορικά με την επίδραση των DRMs σε παραδοσιακά πεδία της ΠΙ. Στο τελευταίο κεφάλαιο της παρούσας συνάγονται συμπεράσματα ως προς τον ρόλο που πρέπει να διαδραματίσει το Δίκαιο της ΠΙ κατά τη μετάβαση και προσαρμογή του στην νέα "ψηφιακή αγορά" - με σταθερό σημείο αναφοράς την περίπτωση των ΨΒ - αλλά και ως προς την ανεπάρκεια των ισχυουσών νομοθετικών ρυθμίσεων, προκειμένου να επιχειρηθεί, εν τέλει, η παράθεση προτάσεων και λύσεων υλοποιούμενων άλλοτε από τον Νομοθέτη, άλλοτε από τον Δικαστή και άλλοτε από ήπιες διαδικασίες διαπραγμάτευσης και αυτορρύθμισης.
Abstract:Τhe present master thesis put emphasis on authors' copyright violation and protection aspects, especially when their works are subject to "digitization" on the Internet, in order to finally be part of a Digital Library. The main motive for this research has been the real case study of the "Google Library Project" (as part of the wider "Google Books Search Project"), which is being developed by this thesis as an introduction to the subject of study. The problem that has arisen has to do with the fact that Google via "Google Library Project" has digitized and hosts million of scanned books from various U.S. University libraries and other collections, without taking into account any copyright law issue for either in - copyrighted books or "out of commerce" or "orphan works". At first, the new definition of fundamental intellectual property concepts and principles is given in order for the reader to apprehend the whole "Digital Library" project while the differences to the traditional ones are also being identified. The relevant International, European and National copyright legislation is quoted as well as with brief comments on the U.S.A. Copyright Law. The legal recognition and the application of the (recently known as) "digital rights" is the next subject concerning this thesis (considering them as expressions of the wider intellectual property right), as well as the way these new digital rights are granted to authors. Moreover, limitations and exceptions is another aspect that this paper is referring to focusing, in particular, on the private copying exception and the so called "3 - step test". It's being outlined in advance, that massive digitization serving a purpose such as a Digital Library project, does not subject to any of the statutory exceptions, included the private copying exception. Furthermore, due to the technological developments, new contractual forms have introduced themselves in the field of the commercial exploitation of an in - copyrighted work, such as the General Public License and the Creative Commons movement, providing an automated licensing mechanism which greatly applies to the "Digital Libraries" case. The following chapter, is referred to the moral right of a digital work's author, whose digital work has been digitised and been available on line and also outlines the several ways that the author's moral right may be violated either during the creation process or the use of a Digital Library. After categorising those actions or technological methods that constitutes a breach of the intellectual property rights (or the neighboring rights) existing over a digital work, this paper deals with the problem of the "orphan works" in relation to the massive digitisation projects. On the following chapter the intellectual property rights enforcement system is briefly presented accompanied by comments on relevant case law, as well as the Technological Protection of the Intellectual Property through the Digital Rights Management systems or the Rights Management Information. Lastly, this thesis reaches to a number of conclusions considering the essential need for the Intellectual Property Right Law to adapt to the transition from the analogue to the new "digital market" environment - reference point of which remains the Digital Library case -, the insufficiency of the copyright legislation in force to encounter digital environment's new data, so as to finally be in the position to make recommendations and propose solutions to be materialised either through legislation, judicial practice or even better, through a soft - law approach based on negotiation and self - regulation initiatives by the interested parties.
