This paper presents the issue of the relationship between intellectual property and Competition Law. The interface of Intellectual Property and Competition Law is an issue that concerned the European Court of Justice, practitioners and academics due to the fact that boundaries that define the scope of IP and antitrust Law are far from clear. On the one hand, intellectual property laws create exclusive rights that provide incentives for innovation. Antitrust laws, in turn, ensure that works are promoted in a competitive environment and foster competition by prohibiting anticompetitive mergers and the abuse of a dominant market position.
