Περίληψη:De plus en plus souvent, les missions d'enquête sont confrontés à des épisodes qui semblent prima facie d’avoir la quantité de crimes internationaux. Ces allégations portent de lourdes obligations supplémentaires pour les Etats, puisque le droit pénal international impose des obligations précises sur les autorités nationales, quand un crime international a prétendument été commis. En outre, bien que les mécanismes d'établissement des faits soient rarement chargés de l'identification des auteurs, la simple apparence de la commission d'un crime international devrait déclencher l'ouverture d'enquêtes pénales et, le cas échéant, des poursuites, ce qui, par définition, a des conséquences sur le droit de l'individu. A la lumière de ces observations et à l'absence de coordonnées précises, on peut se demander quelle place, dans le processus de reddition de comptes pour les violations flagrantes des droits de l'homme, est remplie par des faits. Le présent travail vise à analyser le phénomène de faits international dans le domaine des droits de l'homme à travers l'étude d'un cas controversé particulier: la Mission d'établissement des faits du conflit de Gaza, mis en place en réponse aux opérations militaires menées par Israël dans la bande de Gaza, entre le 27 Décembre 2008 et le 18 Janvier de 2009. Le travail est structuré en deux chapitres. Le premier chapitre vise à décrivant le phénomène de faits, à travers l'analyse des réglementations existantes de «soft law». Un aperçu de l'évolution de l'instrument, depuis ses premières apparitions, est fourni. La crédibilité, comme la principale source de légitimation, est également abordée, en identifiant les éléments qui peuvent améliorer et nécessitant par conséquent un règlement complet. Un aperçu des meilleures normes de preuve devant être adoptée par d'enquêteurs afin d'évaluer les éléments de preuve concernant les faits spécifiques, est également inclus. Suite à cela, la pratique du Conseil des droits des Nations Unies en ce qui concerne les fonctions d'enquête et de monitoire est décrite, en introduisant l'objet des chapitres suivants. Le deuxième chapitre porte sur l'analyse de l'étude de cas choisie: la Mission d'établissement des faits sur le conflit de Gaza, mis en place par le Conseil des droits de l'homme en réponse à l'opération militaire, baptisée Opération Cast Lead, lancée par les Forces de défense israéliennes sur la bande de Gaza, entre le 27 Décembre 2008 et le 18 Janvier 2009. Tout d'abord, une analyse de la genèse de la Mission est fourni, afin de contextualiser son mandat et de la méthodologie. En second lieu, le produit de son enquête, la mission d'enquête sur le conflit de Gaza Rapport, également connu sous le «Rapport Goldstone», est mis au centre de la recherche, qui donne un aperçu de sa structure. En troisième lieu, le contenu du rapport est supposé que la base d'une analyse de la méthodologie adoptée par la Mission. En particulier, certains défis que des enquêteurs peuvent rencontrer dans la poursuite de leur mandat sont traités. Parmi eux, on peut rappeler les difficultés inhérentes à l'application du droit international humanitaire, lorsque le processus de collecte de l'information est limitée en raison d'un manque de coopération des États, ainsi que l'application controversée des normes différentes, découlant de la pertinence concomitante du droit international humanitaire et droit international des droits de l'homme. En outre, plusieurs violations du droit international humanitaire et les droits de l'homme impliquent la responsabilité pénale des individus, la recherche souligne également les obstacles implicites à toute évaluation non-judiciaire de la mens rea pertinents, requis par le droit pénal international.
Abstract:More and more often, fact-finding missions are faced with episodes that seem prima facie to have the amount of international crimes. These claims bear heavy additional obligations for States, since international criminal law imposes specific obligations on national authorities when an international crime was allegedly committed. In addition, although the mechanisms for establishing the facts are rarely responsible for the identification of perpetrators, the mere appearance of the commission of an international crime should trigger the initiation of criminal investigations and, where appropriate, prosecution, which by definition has consequences for the rights of the individual. In light of these findings and the absence of specific details, one may wonder what place in the accountability process for gross violations of human rights, is filled with facts. This work aims to analyse the phenomenon of international developments in the field of human rights through the study of a controversial special case: the mission of finding the Gaza conflict, set up in response to military operations by Israel in the Gaza strip between 27 December 2008 and 18 January 2009. The work is structured in two chapters. The first chapter is to describe the phenomenon of facts, through analysis of existing regulations of "soft law". An overview of the development of the instrument, since his first appearances, is provided. Credibility, as the main source of legitimacy, is also covered, identifying elements that can improve and consequently requiring a complete settlement. An overview of best evidential standards to be adopted by investigators to assess the evidence concerning specific facts, is also included. Following this, the practice of the UN Human Rights Council regarding the investigation and monitory functions is described by introducing the subject of the following chapters. The second chapter focuses on the analysis of selected case study: Mission-finding on the Gaza Conflict, established by the Council of Human Rights in response to the military operation, dubbed operation Cast Lead, launched by Israel defence Forces on the Gaza strip between 27 December 2008 and 18 January 2009. First, an analysis of the genesis of the Mission is provided in order to contextualize its mandate and methodology. Second, the product of his investigation, Finding Mission on the Gaza Conflict Report, also known as the "Goldstone Report" is set in the centre of the research, which provides an overview of its structure. Third, the report content is assumed that the basis of an analysis of the methodology used by the Mission. In particular, some of the challenges that investigators may encounter in pursuing their mandates are treated. Among them, we can recall the difficulties inherent in the application of international humanitarian law when the information gathering process is limited due to lack of cooperation of States and the controversial application of different standards, resulting from the concomitant relevance of international humanitarian law and international human rights law.
