Abstract:This master's thesis deals with the smooth and effective functioning of the relations between travel agencies, hotels and client-tourists within the Community as well as globally. There is a detailed presentation of the legislative framework of this tripartite relationship through the description of the most popular tourist law contracts, such as package travel contracts “all inclusive” and hotel contracts “allotment” and “guarantee”.The first chapter gives, a detailed description, of the package travel contract and analyzes the provisions of the Council Directive 90/314/EEC on package travel, package holidays and package tours and its integration into the Greek legal system, from the perspective of consumer protection. Furthermore, after a brief presentationof the Regulations of air transport: 261/2004/EC, 889/2002/EC, that are closely tied to the package travel, it is following a critical assessment of the aforementionedlegislation, highlighting the urgent need of its revision. This is felt to be essential to the proper conduct of contractual relations in tourism, that has been affected to a large extent, over the last three decades, by the rushing invasion of the internet in our lives. The purpose of the second chapter is the function of the wholesale hotel contracts between travel agencies and hotels, citing the differences between “allotment” contracts and “guarantee” contracts. My overall research is permeated by case-law of the Court of European Union and Greek civil courts. My thesis concludes with a chapter related to private international law, offering a description of the Regulations “Rome I” on the law applicable to contractualobligations and “Brussels I” on jurisdiction and the recognition and enforcement of judgments in conflicts related to international tourism law contracts.
