Abstract:
During its development the concept of equality has undergone many different interpretations, depending on the conditions and the state of the awareness prevailing in society at the relevant time.At first it was simply interpreted as meaning equal treatment, which led at the same time to the emergence of the opposing concept of special needs for women, implying that they required special treatment . As more and more researchers began to participate in the feminist movement with the aim of achieving gender equality, and after they have already achieved their initial objectives, the focus is turning towards hidden aspects of gender inequality. But if equality has been achieved, why are women still paid less, why are they the overwhelming majority of victims of violence and sexual abuse, why have they not achieved social equality, which is the ultimate goal of gender equality? Since there can be no concept of equality without a definition of a standard person as a reference value for what is considered equal, why does this standard person have male characteristics and needs? Specifically, why does the prison system not take into account the needs of the female gender? Should in this field gender equality be interpreted in relation to the consequences suffered by the inmate?All these questions created the need to formulate a new theory of equality which deconstructs gender and detects the difference between the sexes, not in relation to socially constructed characteristics, but instead in relation to the hierarchy that is present in relationships between women and men .It is desirable therefore, to study the Greek constitutional legislator’s definition of gender equality and to investigate whether its application in the areas of family and criminal law meets constitutional requirements.
