Abstract:Improving the quality of the legislation is a prerequisite for good governance in European Union in accordance with the requirements of the Commission’s White Paper on European governance which was adopted in 2001. Every successful attempt to reform governance should be accompanied by measures to improve the quality of regulatory and legislative environment and this is the main purpose of the European strategy for Better Regulation. This far-reaching program was inaugurated in 2002 and it is designed to cut red tape, improve the quality of regulation and design better laws for consumers as well as business. Better Regulation provides legal certainty, effective implementation and enforcement of Community rules throughout the European Union.This essay gives an overview of the Better regulation agenda focusing on the crucial points of its adoption and implementation.The Better Regulation program applies to all stages of the policy cycle and includes a mix of different actions. In particular, improving existing legislation is the first priority of the program and includes actions to simplify and modernise the community acquis through legislative techniques such as recast, repeal or codification and actions to reduce administrative burdens imposed by European legislation. It also promotes the proper use of existing legal instruments and the use of alternative methods of regulation in suitable cases. For new proposals, impact assessment is a key tool to ensure that the European legislation is prepared on a basis of transparent, comprehensive and balanced evidence. Furthermore, consultation mechanisms are adopted and should form part of the activities of all European Institutions throughout the whole legislative process, from policy-shaping prior to a Commission proposal to final adoption of a measure by the legislature and implementation.Finally, Better Regulation should be a priority not only for the European institutions but also for member states as a common responsibility given that, ultimately, the European legislation is implied to the member states.
